Florida Senate President Don Gaetz demonstrated his view of the US Constitution when responding to citizens who are urging the State of Florida to join a growing number of states, which refuse to implement Health Care Exchanges mandated by Obamacare.
Florida citizens are urging the State legislature to exercise the 10th Amendment or Nullification, one of the Constitutional safeguards afforded them, to protect against the federal government seeking to exceed certain and limited enumerated powers granted to the federal government as specified within the Constitution.
Responding to Constitutional expert, and former Florida State Prosecutor, Krisanne Hall in an email regarding Obamacare Senator Gaetz suggests shooting or hanging citizens who attempt to fulfill their duty to exercise this Constitutional safeguard and went on to say, “I have sworn an oath on my father’s Bible before Almighty God to preserve, protect and defend the constitution and government of the United States.”
Hall states, “After sending Senator Don Gaetz my letter explaining the positions of James Madison, Thomas Jefferson and Alexander Hamilton on State Sovereignty, Mr. Gaetz says that citizens who agree with the writer of the Declaration of Independence should be summarily shot and hanged.”
In other emails, the Senator said “the US Supreme Court ruling upheld the law’s constitutionality and the election results make the law’s repeal unlikely. Therefore, it is my view that we must now abide by the law, participate in its implementation, and work to ensure that the interests of Floridians are protected.” And “Over the next several weeks and months this committee will work to meet our shared goal of finding the best approach for implementing this federal law and limiting its costs.”
Obviously, the founders in their wisdom knew a duplicitous Oath could create a conflict not in the best interest of the Republic should individual branches of government (Legislative, Executive, and Judicial) fail to perform the intended checks and balances and begin to act outside the confines of the law or Constitution.
The purpose of the Constitution is to allow citizens to throw off tyrannical governments, not to capitulate to unjust laws. The Florida Senate’s responsibility is to represent and protect the State and not the Federal Government when it exceeds it power.
The 2nd Amendment and the 10th Amendment are a duty placed upon the shoulders of every citizen by the Founders of the only Constitutional Republic the world to ensure its preservation.
